Welcome to Ziggy B's Spice Blends! These Terms & Conditions ("Terms") govern your use of our website and your purchase of products from Ziggy B's Spice Blends ("Ziggy B's," "we," "us," or "our").

•Slight variations in color, size, and appearance may occur due to the artisan nature of our products
•We reserve the right to modify product offerings, recipes, and ingredients without notice
•Weights and serving sizes are approximate

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. The price charged for a product will be the price displayed on our website at the time you place your order, subject to the following:
•Pricing errors: If we discover a pricing error after you've placed an order, we will contact you to inform you of the error and give you the option to cancel your order or pay the correct price
•Taxes: Applicable sales taxes will be added to your order total at checkout
•Delivery fees: Delivery fees (if any) will be clearly displayed before you complete your order

All products are subject to availability. We reserve the right to:
•Limit quantities available for purchase
•Discontinue products at any time without notice
•Refuse orders that exceed reasonable quantities for personal use
If a product becomes unavailable after you've placed an order, we will contact you promptly to offer a substitution, credit, or refund.

2.You receive an order confirmation (this is not an acceptance of your order)

4.You receive an order acceptance confirmation once we've accepted your order
We reserve the right to refuse or cancel any order for reasons including but not limited to:
•Product unavailability
•Pricing or product description errors
•Suspected fraudulent or unauthorized transactions
•Orders that exceed reasonable quantities
•Inability to deliver to the specified address

 

3.2 Payment
We accept the following payment methods:

Payment is due at the time of order placement unless other arrangements have been made in advance.
Payment security: All payment transactions are processed through secure, PCI-compliant payment processors. We do not store your complete credit card information on our servers.

•Order confirmation: You will receive an email confirming receipt of your order. This is not an acceptance of your order.
•Order acceptance: Your order is accepted when we send you an order acceptance email or begin preparing your order, whichever comes first.
•Contract formation: A binding contract is formed when we accept your order.

 

4. Delivery and Pickup

 

4.1 Delivery Area
We currently deliver to the following Houston-area communities:
•Friendswood
•Dickinson
•Clear Lake
•Pearland
•Webster
•League City
•Alvin
•Manvel
Outside our delivery area? Please contact us at 346-365-7537 before placing your order to discuss possible arrangements.

 

4.2 Delivery Terms
•Delivery scheduling: Delivery dates and times are estimates and not guaranteed. We will make reasonable efforts to deliver on the scheduled date.
•Delivery requirements: Someone must be available to receive the delivery. Our products are perishable and must be refrigerated immediately upon receipt.
•Failed delivery: If no one is available to receive the delivery and we cannot leave products safely, you may be charged a redelivery fee or forfeit your order.
•Delivery fees: Delivery fees (if any) will be clearly stated at checkout.

 

4.3 Pickup
Pickup is available by appointment. When you choose pickup:
•You will receive confirmation of your pickup time and location
•You must bring your order confirmation and valid ID
•Products must be picked up at the scheduled time. Late pickups may result in order cancellation without refund.

 

4.4 Shipping
We do not currently offer shipping. Our products are fresh, never frozen, and require local hand-delivery to maintain quality.

 

5. Cancellations and Changes

 

5.1 Order Cancellations
Cancellation within 48 hours of order placement:
•Full refund available

Cancellation after 48 hours:
•Deposits and payments may be non-refundable once ingredient sourcing and preparation have begun
•We evaluate cancellation requests on a case-by-case basis
•Contact us as soon as possible to discuss options

 

5.2 Order Modifications
Modifications within 48 hours of order placement:
•Changes to products, quantities, delivery date, or delivery address are generally accommodated

Modifications after 48 hours:
•Changes may not be possible depending on preparation status
•Contact us immediately to discuss options

 

6. Returns, Refunds, and Satisfaction Guarantee

We stand behind the quality of our products. If you are not completely satisfied with your order, we will work with you to make it right.

 

6.2 Reporting Issues
If there is a problem with your order:

2.Provide your order number, description of the issue, and photos of the product
3.We will work with you to determine the appropriate resolution
Why 24 hours? Our products are fresh and perishable. Quick reporting allows us to assess the issue while the product is still fresh and determine the best solution.

 

6.3 Resolution Options
Depending on the situation, we may offer:
•Replacement product (if timing allows)
•Credit toward a future order
•Partial or full refund
•Other resolution appropriate to the circumstances
We reserve the right to evaluate each situation individually. Due to the perishable nature of our products, we cannot guarantee replacement or refund in all circumstances.

 

6.4 Non-Refundable Situations
Refunds or replacements may not be available if:
•You do not report the issue within 24 hours of delivery
•The issue is due to improper storage or handling after delivery
•You refuse to provide photos or documentation of the issue
•The issue is due to personal taste preferences (e.g., "I didn't like the flavor")
•You provided incorrect delivery information resulting in delayed or failed delivery

 

7. Food Safety and Allergens

 

7.1 Your Responsibility
You are responsible for:
•Communicating all food allergies, dietary restrictions, and ingredient concerns BEFORE placing your order
•Properly storing products immediately upon receipt (refrigeration required)
•Following cooking and reheating instructions provided
•Checking product condition upon receipt and reporting any issues within 24 hours

Our kitchen handles common allergens including:

•Shellfish

We cannot be held liable for allergic reactions or food-related illness if:

•You did not follow provided cooking or preparation instructions
If you have communicated your allergies to us, we will provide accurate ingredient information and make reasonable efforts to accommodate your needs. However, we cannot guarantee an allergen-free environment.

9.2 User-Generated Content

Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas. You consent to the jurisdiction and venue of these courts.

 

11.3 Informal Resolution

12. Miscellaneous

 

12.1 Entire Agreement
These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Ziggy B's Spice Blends regarding your use of our services.

 

12.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

12.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
